presidential debate is in the books. >> looking at the cbs news instant polls, the former governor apparently knocked it out of the park. 500 uncommitted voters were asked who won this debate. 46% said romney was the winner, while only 22% said that the president was the victor this time. as for their view of romney, the man who has been fighting to ensure that he relates to the average american, 56% of the polls said they had a better opinion of the former governor after this debate. what started out as cordial quickly became heated. >> his proposal calls for a $5 trillion tax cut on top of $2 trillion of additional spending for the military. and he is saying that he is going to pay for it by closing loopholes

and deductions. he's been asked over 100 times how he would close those loophole, and he hasn't identified them. >> if the tax plan he described airplane tax plan i was asked to support, i'd say absolutely not. i'm not looking for a $5 trillion tax cut. i've said i won't put in place a tax cut that adds to the did deficit. >> five weeks before the election, he's saying the his big idea is never mind. >> my priority is jobs. there's nothing better. having more people working, earning more money, paying more taxes. that's the most efficient way to get this budget balanced. >> reporter: romney knead the case he would be -- made the case he would be better at creating jobs. >> does anybody think the big problem we had was there was too

much oversight and regulation of wall street? >> we have to have regulation of wall street. but i wouldn't designate five banks as too big to fail. this is the biggest kiss given to new york banks. >> reporter: onto healthcare, romney returned his recurring theme, calling obamacare a job-killer. >> i don't know how the president could have come into office facing 23 million people out of work, rising unemployment, and spend his energy and passion for two years fighting for obamacare instead of fighting for jobs for the american people. >> reporter: the president argued that romney must have liked healthcare reform at some point. >> the irony is that we've seen this model work really well. in massachusetts. governor romney did a good thing. >> reporter: then it was onto leadership. romney complied there has been a lack of it in

washington with the president at the helm. >> i like the way we did it in massachusetts. in my state, we had republicans and democrats come together. you pushed through a plan without a single republican vote, instead of bringing america together, and having a discussion, you pushed through something that you thought was the best answer. >> reporter: the president indicated that romney may not know what he's getting into. >> he's going to have a busy first day because he's also going to repeal obamacare, which will not be popular. >> reporter: let's talk about the exit poll of uncommitted voters. 46% say romney won. does that jive with what you saw? >> well, i think -- i know the people in the bay area are democrats and biomimicry-supporters -- obama-supporters. but the president did not have a good

night tonight. governor romney was a clear victor tonight. the question politically, is is it going to matter in the election? that's why the sampling of undecided voters matters. and i would say that those findings are significant if there are a lot of ub decided voters. -- undecided voter. we know that these debates tend to reenforce preferences. a lot of people have already made up their mind. did anybody's minds get changed? my guess is not in this case. the nod goes to governor romney, but i don't know if it's going to change the election just yet. >> reporter: you talked about body language. we know that romney has done 19 debates in the past year: the president not had had one for four years. >> and he's had practice. but in this instance , the president i think forgot something he learned before. when you're showing a split screen, you don't want to be looking down, you don't want to be looking as

if you're jump barely tolerating having to put up with them there. and that was the visual coming across a lot of times. it tends to reenforce the idea that is false, but visually comes across that romney was making headway and the president was just barely tolerating it. when someone is talking to you, you should be looking back at them, smiling, is not making it look as if they're getting to you. >> reporter: we know romney has been criticized for not being specific, and the president takes the shot. >> he says he's going to replace obamacare, and assure all the good things are in it are going to be in there, and you don't have to worry. at some point, i think the mensh people have to ask -- america people have to ask themselves, is the reason governor romney is keeping all these replace secret because they're too good? >> reporter: your reaction? >> this was probably one of the better moments. i think the

president tonight was a little subdued, and it took him a long time to get to that. i do that too. [ laughter ] >> the larger point that the president made, he needed to say something directly to romney, he didn't do that. >> reporter: and on big did, we talked about this all night. >> i'm going to stop the subsidy to pbs. i like big bird. i like you too. upon but i'm not going to keep spending money on things to borrow money from china to pay for. >> big bird might go, and by the way, pbs, comes out of massachusetts, by the way. it showed that mitt romney was prepared, he used some humor tonight, he wasn't afraid to go at the moderator in that way. i think he was tongue in cheek for much of what he was saying. the larger point was let's not spend

money and get ourselves into debt with china buying up most of our bonds. and that's a point that will resonate with some people. of the big thing romney did in closing, he stayed focused on jobs. i think it was a good night for him for that reason. >> and the polls showed that as well. thank you so much. he'll be back next week for the vice presidential debate. >> thanks so much. starting tomorrow , president obama and mitt romney weigh in on the issues in an exclusive presidential forum right here on cbssf.com. a man sitting on the cal train tracks in the south bay is hospitalized this evening not because he was hit by a train, he was shot by police. why recovers say they felt compelled to open fire. >> reporter: he was acting erratically, strangely, and police say when they first contacted him, he was laying

across the tracks. video from chopper 5 shows clothing and other items strewn about the crime scene. >> it was not necessarily what you would call a typical foot-pursuit. it lasted several minutes. >> reporter: a man was spotted wandering on the tracks. san mateo county sheriff's deputies provide security for cal train and ordered the man to stop, but he kept walking. they walked more than a quarter-mile down the track. by the time backup got there, he armed himself with a metal spike. >> the suspect displayed some type of threatening behavior toward the officers that the deputy believed was a danger to his safety and that of the other deputies, and he fired several rounds at the suspect. the suspect was struck twice. >> reporter: paramedics took him to the hospital with non-life threatening injuries.

the incident shut down service. investigators say the man is 29 years old, lives here in san jose, and is being treated at valley medical center, and will likely face charges of assault. and police in vallejo are at the scene of a shooting that left two people dead on folkstone way at about 6:00 tonight. a man confronted two men who lived across the street, shots rang out, and two bodies were left lying in front of the house. what prompted the dispute is not known, and the suspect is in custody. the campaign took the full 162 games, but tonight the a's sit atop the american league west! talk of the team leaving town than clinching the first round ever the playoffs. who, where, and when will the a's play next? dennis will have the details coming up. and the case involving a police lab technician charged with stealing drug evidence has ended in mistrial. deborah maddon admits she took cocaine from san francisco's crime lab. investigators had to dismiss hundreds of charges because of that admission. the judge declared a mistrial. and a propane tank is suspected of starting a 3-alarm duplex fire in berkeley. it took crews two hours to get it under control. five people living in the home were able to get out safely, including a woman in a wheel chair. and a new shopping concept is unveiled in san jose. the

walmart neighborhood market is now open at the west gate mall. they challenged other groceries in the area. some south bay thieves made off with something more precious than simple possessions. they stole a little girl's puppy! the dog's name is miko. thieves broke into a home near hayes elementary. when they took their puppy, they also took a piece of their heart, the mother says. >> when we came and found out, the only thing i could think of is how am i going to tell my 10-year-old? what mother wants to tell their children that part of their life has been taken away? and i can't do anything about it. [ crying ] >> and it's the second time their house has been broken into. a $6,000 reward is being offered tonight for the return. a dime, a quarter, even more in a matter of days. what

all across the bay area. they're up $0.10 to $0.40 in the past couple days. why the pump prizes are rising, as oil prices are going down. >> reporter: it was just last week when drivers were paying $3.95 a gallon. today the same gas up $0.30 to $0.40 more. >> i don't understand the big jumps. >> reporter: tom robinson says prices could go up another $0.50 a gallon before it's over. and it's only happening here. >> this really appears to be just a west coast phenom, primarily california. you have low inventories and refinery problems. >> reporter: a chevron fire was just the beginning. a power failure in torrance have cut supplies. the low inventories caught a lot of distributors

empty-handed. now it's the drivers who are running on empty. >> i might get maybe a quarter-tank on $20. >> reporter: crude prices, ironically, are dropping. >> when you see something that's going on right now that's related to supply issues, refinery problems, what happens as soon as the problems get resolved and they tend to happen relatively quickly, prices tend to drop off fast. >> reporter: no one knows for sure when the gas prices are going to start levelling off and then come down. but it can't come soon enough. some stations in california are already starting to run out of fuel. >> we'll do what we can. you can find the cheapest gas in your area by going to our website.

a different complaint at the chevron refinery. hundreds of people demonstrated this afternoon. activists are demanding safety improvements, solvization, and a reduction -- compensation and a reduction of emissions. a new report warns dozens of weight-loss and dietary supplements don't deliver the results they promise. >> reporter: 20% of supplements have labels that claim to treat a disease, and that's illegal. for example, the government says this label for a product containing vitamins and a compound called dim-complex is legal because it claims to boost the immune system and support overall health, but it does not say it treats a specific disease. this label for a product containing algae and an

herb is illegal because it claims to treat diseases including herpes and the flu. >> this raise report raises questions about the extent to which these claims are truthful and not misleading. the fda doesn't have the ability to look at the substantiation behind the claims, so there's no way for consumers to know if the claims are truthful. >> reporter: federal law classifies them as food, not drugs. products are required to be safe, but the fda only monitors them after they're on the market. when it comes to proof, supplement makers are only required to say research has been done. they are not required to show it to the fda. the natural products association issued a statement saying "this small sample of supplements shouldn't smear the entire industry." the investigators looked at 127 supplements claiming to help with weight

loss. none met the fda's recommendations for proving the products work. fleet week arrives in dramatic fashion.
